What Is Sexual Battery?

Sexual Battery is not the same as Rape. Sexual Battery is defined under Ohio Rev. Code  ยง 2907.03.

This crime involves engaging in sexual conduct with another in which the alleged offender is generally in a position of authority, supervision, or control over the victim. 

Unlike rape, sexual battery need not involve force or threats. Rather, it is the presumed position of power or control that makes the sexual interaction illegal.

Penalties

Sexual Battery is a third-degree felony punishable by one to five years in prison and a fine of up to $10,000. However, if the victim is less than 13 years of age, it is charged as a second-degree felony carrying two to five years in prison and fines of up to $15,000. 

A conviction will also require sex offender registration for life.
