WHAT YOU NEED TO KNOW ABOUT DUI

No one is prepared for a drunk driving arrest. The vast majority of people who are pulled over and charged with driving under the influence (DUI) or operating a vehicle under the influence (OVI) say something like "I never expected it would happen to me."

But it does happen. If you are charged with DUI or OVI, I can help. I defend Ohio clients against DUI crimes. I represent Ohio University students from my Athens office and other clients from my home office in Lancaster.

WHAT TO DO IF YOU ARE STOPPED OR ARRESTED FOR DUI

In general, the best defense is avoidance. If you are reading this, it is probably too late for this advice, but with the strict laws around drinking and driving, it is always best to avoid drinking and driving entirely if possible.

However, if you are caught driving while intoxicated:

  • Cooperate with the police: Do not try to run from the police or be combative in any way. It will only make the situation worse and probably bring additional charges on you.
  • Exercise your rights: Our laws guarantee you the right to remain silent and the right to legal counsel. Exercise those rights. Do not say anything to the police, and contact a lawyer as soon as possible.
  • Protect your driving privileges: After a DUI arrest, even if you are never convicted, you will automatically lose your driving privileges unless you take action. Talk with an attorney right away about appealing this administrative action with the Ohio Bureau of Motor Vehicles (BMV).
  • Seek out alcohol counseling: If you are already seeking out alcohol counseling even before your case is brought before the court, it will go a long way to minimize the potential consequences you could face.
